GENERAL TERMS AND CONDITIONS OF NUTROCON BV
Definitions
In these terms and conditions, the following definitions apply:
“General Terms and Conditions”: these General Terms and Conditions, which apply to every offer made by UNNU (hereinafter the “Offer”), every acceptance by the Customer of an Offer, and in general to every agreement entered into between UNNU and the Customer (each hereinafter an “Agreement”).
“Specific Terms and Conditions”: specific conditions that apply in addition to the General Terms and Conditions to the Agreement between the Customer and UNNU and which take precedence over the General Terms and Conditions.
“Services”: all services provided by UNNU to the Customer under an Agreement.
“Customer”, “you”: the (prospective) contractual counterparty of UNNU to whom an Offer is made and/or with whom an Agreement is entered into, as well as any companies affiliated with the Customer.
“Products”: all products supplied by UNNU to the Customer under an Agreement.
“UNNU”: the trade name of NutrOcon, a private limited liability company with its registered office at Wijnegemsteenweg 161 – 2970 ’s Gravenwezel – Belgium, registered with the Crossroads Bank for Enterprises under number 0804.582.237, hereinafter also referred to as “UNNU” or “we”.
“Website”: the UNNU website (www.unnu.health).
Who are we?
1.1. UNNU sells and delivers flexible, monthly delivered, personalized nutritional supplements based on a membership.
1.2. UNNU also sells one-time personalized supplement courses and offers vouchers, gift cards, and discount codes.
1.3. Supplement courses based on a membership, additional products and/or gift cards, vouchers, and discount codes are all considered Products within the meaning of these General Terms and Conditions.
1.4. For all UNNU supplements, a notification dossier has been submitted in accordance with applicable regulations to the Federal Public Service for Public Health, Food Chain Safety and Environment, which verifies the declared composition and labeling of the product. Market inspections are carried out by the Federal Agency for the Safety of the Food Chain (FASFC). Each supplement is produced in Belgium and has a valid NUT notification number. The presence of a NUT number on the packaging indicates that the content, ingredient quantities, and safety of the product have been checked. The Customer can find the NUT number of each supplement on the enclosed information leaflets.
Applicability
2.1. These General Terms and Conditions apply to every Offer made by UNNU, every acceptance by the Customer of an Offer, and in general to every Agreement entered into between UNNU and the Customer (including memberships and separate orders).
2.2. UNNU reserves the right to amend these General Terms and Conditions. UNNU will inform the Customer of any intended changes at least seven (7) days in advance. If the Customer objects to the amended General Terms and Conditions, the Customer may terminate the Agreement via their account on www.unnu.health, subject to the deadlines for modifications, pauses, and cancellations. Supplements can be adjusted, paused, or cancelled. The modification period is 25 days from the previous order; the exact date can be found in the Customer’s account (the “Modification Period”). If the Customer does not terminate the Agreement in time and continues to use the Products after the announced effective date, the amended General Terms and Conditions will apply.
2.3. Acceptance of these General Terms and Conditions implies that the Customer fully waives the applicability of their own general terms and conditions.
The Offer
3.1. The offered Products and/or Services, including stated prices, constitute a non-binding offer that may be accepted by the Customer.
3.2. UNNU strives to provide a complete and accurate description of the Products and/or Services. However, UNNU is not bound by obvious errors or mistakes in the Offer.
3.3. UNNU’s Offer is directed at end consumers in Belgium, the Netherlands, and other European countries. Ordered Products are expressly not intended for resale. Only household-sized orders are accepted.
Formation of the Agreement
4.1. To place an order, the Customer must create an account to enable personalization and management of preferences. If preferences are not modified in time within the Modification Period, the supplement composition of the ongoing month will be renewed and shipped.
4.2. An Agreement may be entered into for an indefinite or a fixed term.
4.3. To create an account and place an order, the Customer must be at least eighteen (18) years old. UNNU does not sell Products or Services to persons under eighteen (18).
4.4. UNNU may occasionally include additional Products, such as samples or third-party offers. No rights can be derived from receiving such extras.
Obligations of the Customer
5.1. All information provided by the Customer must be accurate and up to date. Passwords must be kept confidential. The Customer bears full responsibility for misuse and indemnifies UNNU against third-party claims.
5.2. The Customer must carefully read and comply with all product labels, instructions, and warnings. UNNU is not liable for damage resulting from non-compliance.
Delivery
6.1. Delivery time windows are indicative. UNNU will make reasonable efforts to deliver within fourteen (14) days. Delays do not give rise to liability.
6.2. Additional delivery charges for specific time slots may apply and will be communicated in advance.
6.3. The Customer will receive an email with a more precise delivery time a few days prior. Delivery may deviate by one (1) day.
6.4. UNNU reserves the right to deliver only after full payment.
6.5. UNNU delivers in Belgium, the Netherlands, and other countries indicated on the Website.
6.6. Delivery is made to the address provided by the Customer. Incorrect address costs are borne by the Customer.
6.7–6.9. If personal delivery is not possible, delivery may be made to neighbors or left at the Customer’s address, at the Customer’s risk. UNNU may outsource delivery to third parties.
Prices and Shipping Costs
7.1. Prices include VAT and shipping within Belgium and the Netherlands unless stated otherwise.
7.2. Certain additional Products may incur surcharges.
7.3. UNNU’s claims are immediately payable.
7.4–7.5. Prices may be adjusted with fourteen (14) days’ notice. Continued use constitutes acceptance.
Payment
8.1–8.9. Payments are processed via the selected payment method. In case of non-payment, UNNU may suspend delivery, retry payments, engage third parties, and charge statutory interest and collection fees in accordance with Belgian law.
Late payment penalties include:

€20 if the outstanding amount is ≤ €150

€30 + 10% of the amount between €150.01 and €500

€65 + 5% of the amount above €500, capped at €2,000
Pause, Cancellation, and Right of Withdrawal
9.1–9.5. The Customer may pause or cancel the Agreement before the end of the Modification Period via their account.
Right of Withdrawal – Returns
9.6. Personalized products cannot be returned. Standard pouches may be returned within fourteen (14) calendar days if unopened.
Return shipping costs are borne by the Customer. Refunds are issued within thirty (30) days. If free shipping was initially applied but the order value falls below €45 after return, shipping costs will be deducted.
Vouchers, Discount Codes, Gift Cards
10.1–10.7. Vouchers and discount codes are subject to conditions, non-transferable, single-use, and may be revoked in case of misuse or fraud.
Liability
11.1–11.7. UNNU’s liability is limited to direct damage and capped at the invoiced amount, except in cases of intent, fraud, or bodily injury.
Privacy
12.1–12.2. Personal data is processed in accordance with UNNU’s privacy policy available on the Website.
Fraud
13.1–13.2. UNNU may investigate and terminate accounts in case of suspected fraud.
Complaints
14.1–14.2. Complaints can be submitted via info@unnu.health. The Customer may also use the EU ODR platform.
Intellectual Property
All intellectual property rights related to the Website and Services belong to UNNU or its licensors.
Miscellaneous
16.1. Belgian law applies.
16.2. Disputes fall under the exclusive jurisdiction of the courts of Antwerp.
16.3. Invalid provisions do not affect the validity of the remaining provisions.
Legal Guarantees
17.1. UNNU remains liable for lack of conformity or hidden defects in accordance with Book VI of the Belgian Code of Economic Law.
